Legal Question in Criminal Law in California

public intoxication

I got in trouble in 2004 for public

intoxication and had gone to court

with a public defender. In court I had

the option to just do a 90 day

restriction probation from that area

and it would go on my record only as

a infraction. But recently I had

background check taken for a job

and it said that I had a misdemeanor

on my report. How do I go about

taking care of this?
