Legal Question in Criminal Law in California

I was pulled over for my registration being expired. I was under the influence of a controlled substance. Officer searched my truck and explained if I told him where it was he would be easier on me for telling the truth. So I did tell him and he was easier on me as far as not adding additional items to my arrest report. He arrested me for transporting of a controlled substance and possession of a pipe. I had just bought 1.27 grams of meth which was in two little baggies and I was on my way home when I got pulled over. It was only for personal use, I only buy once in a while hence the two bags and I also get a better deal that way. Any how, I have no priors, I have a clean record. I have a bachelors degree and stable job of 4.5 years. Im clean cut and well educated. What's the chance of being convicted of transporting for such a small amount? In addition I was truthful with the officer and polite. Am I looking at doing time or can I get possession and avoid jail with rehab or something?

Depending on the charges that are presented at your arraignment you may be eligible for either diversion or DEJ. If you have other charges that you are not telling about, you may have problems qualifying for the program. With those programs, you are asked to plead guilty and are ordered to go to a treatment program approved by the County. If you successfully complete the program, and do not break any more laws or probation terms within the probationary period, the court dismisses the case. If do not comply, you are put in a program known as Proposition 36.
