Legal Question in Criminal Law in California

ok

I was pulled over for speeding and the cop asked me to get out of the car so I did. He asked me to follow his finger with a light in my face so i did.

He pat searched me and was really rough with me. I had not been drinking and i told him that. Before I knew it i was on the ground cuffed and being beat with a club and cursed at. Eventually I was put in the police car and arrested. I was charged with obstruction of justice, driving under the influence and battery on an officer. I never touched the cop but while he was cuffing me he got grass stains on his knees. I asked many times to have a breath test or a blood test to prove i was not drunk and they refused. After I was bailed out of jail 1000 bailso I gave 115 to get out. Well they took my license and i got a temporary one it was a pink piece of paper. It had a box the was xed and stated that i refused the alcohol test. I resisted arrest in a way because I was scared and they were hurting me. I tightened up my arms just for a second but I was not going crazy or anything. The cops are totally not telling the truth. I was just an asshole thats all. What should i do.

You are now in the criminal justice grinder. The Police report starts the process and the district attorney will believe all that is in the police report. The charges are serious and you will need an attorney to present your side of the story. I'm sure the "refusal" to take a test has two sides to the story. Read the pink copy of your temporary license very carefully because it contains much important information.

I agree with the prior postings by attorneys on this BBS. You do have some serious charges against you and you must retain an attorney. I believe your story. You need to get a good criminal law attorney on your side. If you were in Orange County or one of the contiguous counties there is a retired D. A. and retired Judge that I'd recommend. I'd still check out one of the retired judges that did a lot of criminal law that may be practicing law and talk to him or her.

Then you need to write down all the facts as they occured paying particular attention to where you'd been before the arrest, and get all the names, telephone numbers, and addresses of all the people you had interacted with right up to the time your arrested.

Take a lot of pictures of the scene of the incident and also pictures of yourself to show any bruises, etc.
