Legal Question in Criminal Law in California
pure perjury
I have clear cut perjury against five individuals and one who clearly lied to the police. Due to some nut trying to take her phony restraining order and make it criminal, an investigator for the Public Defender uncovered that they all were lying and lucky for me they forgot what they'd said in court completely. But, two of them in court were committing perjury that in a rational world would have been caught by the judge. But, he seriously was crooked. It's not ambigous- they lied and lied to get ahead in the comedy business. gross tale..and the lawyer for this person gave in anaffadavit that she knew to be false and she also needs to be held accountable.
The facts are that I have investigator repots and clear cut evidence that four people completely lied in court and the plaintiff lied about 4 times in affidavits etc. I want to show this to the court that ordered this bogus restraining order and I need help ie. is it a motion, is it a brief. What can I do to show the court that they lied and that they should by all means be prosecuted for perjury because all the facts of this case show that I've been so abused by them and the system in this matter.

Well it sounds as if you have several issues. First, overturning/dismissing the restraining order against you by way of newly discovered evidence. Contact an attorney to assist you. Second, prosecuting the perjury. You should contact either law enforcement or the District Attorney's Office or both in the county where the perjury took place and request that charges be filed. Third, the attorney who signed an affidavit, knowing it to be false, can be sanctioned by the State Bar. You can log onto the California State Bar's website and download the forms to file a complaint against that attorney.
