Legal Question in Criminal Law in California

How does someone qualify for a cruise waiver?

We live in California and my boyfriend may take a deal on a burglary case. We just had a baby and I was wondering if he took a deal, would he get a cruise waiver possibly? What would qualify you to get one? He is not violent and has no strikes. Thank you

A Cruz waiver is an agreement for a plea deal for a speific sentence, but if the defendant doesn't show up to remand or for sentencing, the plea stands, but they can get up to the maximum.

Ask his attorney if he wants to take that risk/deal.

Such a waiver is usually the product of negotiations between the prosecutor and his attorney. It sounds like it might be a case where this kind of waiver is possible. Hopefully your attorney can obtain that for your husband. David Wallin at www.wallinlaw.com
