Legal Question in Criminal Law in California
Hello, my question is, I just got caught for petty theft at a walmart it was $115 worth of stuff .. My court date is aug 22 and I have no idea what to do iv been in panic mode and crying mode this is my first time stealing and offense for petty theft.. What will the judge give me or what steps should I do to try to clear this.. Can I make it an infraction, can I go to classes? Can I just ask the judge for a fine? I don't want probation or community service but I know that's what's going to happen.. I'm so scared.. Help!!

My best advice is to hire an experienced criminal lawyer to represent you. There are many issues involved in a petty theft charge. Which ones will be present in your case is presently unknown. But a petty theft is very defensible regardless of your acknowledgment that you did it. It is impossible to predict, with this little information, what a judge may do. "also stay out of that store or chain. Don't talk to anyone who contacts you saying they represent the store. Do not pay any civil demand for payment ... many people get letters implying if they pay now, they will not have a criminal case. The store does not necessarily have that authority, and payment (or statements) can be used as evidence of guilt. Forward the letters to your attorney. Good luck!"
