Legal Question in Criminal Law in California

Question criminal lawyer

I was involved in a brawl, I did not started it, somebody called the cops, they arrested me, took me to the station and the cop made threats to me while in the police car; in the basement of the police station I was handcuffed ,the cop made gestures as if he was going to hit me in my face with his fist he uttered expletive stuff toward me, we were alone at that time until another cop arrived ,they booked me but they did not charge me with anything, and then they released me without any charges.

Can they do that??? book me without any charge....?????(I think it was racially motivated) what do you think???

Re: Question criminal lawyer

It possibly could be racially motivated. If you feel it is, you should consider filing suit against the city where it happened.

My view is that if they did not file any charges, thank your lucky stars and let the bygones be bygones. Cops misbehave all the time, often in much worse way than in your situation.
