Legal Question in Criminal Law in California

question

I drove a mini van to walmart to shop

for 20 minute after come out my mind just went blank and i thought i drive

a different car. I look for it for a while could not find it

then i call the police and give suspect name as my brother in law as stoler. they come

to his home to ask question. Can my brother in law sue me for any reason. if what penalty do i get?

since i later relize my mind went blank the car is not stolen and i

apoligize him right a way

Yes, he probably could sue you for defamation and negligence to name a few. However, a lot would depend on what his damages were, if any. Was he arrested? Did he lose his job over this? Did he have to hire an attorney?

Work it out with him as best you can and be more careful in the future.
