I just finished asking the following question:

What would happen legally to my friend if he is caught for forging someone's signature on a check after he cashed it? The check was mistakenly sent to his address and the name on the check was close enough to have it cashed at a mom and pop shop. The check was nearly $800. And the police have already been informed. My friend's family is only wondering what to expect. Can you tell me what legal proceedings may occur? Jail time (approximately how long), fines, community service, and/or probation. We want to know the consequences.

If jail time is necessary, can you tell me approximately how much time he's looking at? I know it depends on a number of factors, but I'm just looking for a rough estimate. The reason for my asking is because his little girl has a broken leg and his undivided attention is currently given to her. We're trying to help, but asking this question online is really all I can offer him. Thank you kindly.

Forgery is a wobbler, which means it can be charged as a misdemeanor, punishable by up to a year in jail, or a felony that could result in a prison sentence up to three years.

If your friend is a first time offender, it is unlikely that he would be sentenced to prison, but he can probably expect probation and some jail time.
