Re: what is a ramiro motion

A Romero motion is a motion to strike one or more of the alleged strike priors in order to reduce the maximum possible sentence on a case.

If you are charged with a felony and you have priors that qualify as strikes (serious or violent felony), then your maximum sentence is increased. A felony with one strike prior doubles the sentence. A felony with two strike priors increases your sentence to 25 years to life.

If the judge agrees to strike one or more of the strike priors, your maximum sentence will be reduced accordingly. The judge must state good reasons for striking the prior - e.g., minimal role in crime, priors are very old, etc.
