Legal Question in Criminal Law in California
I received a misdemeanor on September of 2010 for a false id charge in California. It wasn't until November 2010 where i went to court and paid only a fine. No probation or jail time was served. I was wondering how long do i have to wait to get my record expunged?

With the limited information that you supplied, I can give you a general answer. To apply for an expungement, pursuant to 1203.4 pc,, one must have completed all the terms of probation and probation needs to be completed for a misdemeanor charge. Many courts will consider an early termination of probation after half of the term has been served. Other factors to be considered by a professional defense attorney would be,1) the type of charge, 2) the facts of the underlying case, 3) has the defendant ever violated any terms of probation during the time they were on probation,4) the reason for the request for the early termination,5) the particular court and background of the judge's prior conduct in matters such as the one presented, and other factors. You should contact a criminal defense specialist in the area to obtain a consultation before you proceed with this matter. I wish you the best. David Wallin
