Legal Question in Criminal Law in California

Just recieved a ticket for MIP.

Hi. I'm 18 years old and a freshman at Ventura College. Last night, 6/13/08 I recieved my first MIP in Isla Vista, a town in Santa Barbara. I was drinking vodka and cranberry juice out of a red dixie cup when the sheriff rolled by and busted my friend and I. I was not acting like an idiot or being rowdy at all, just standing there minding my own business. Anyways, the cop asked for my ID and asked what was in my cup. Truthfully, I responded to what it was, knowing that he would just sniff the cup and then probably charge me with lying to a police officer if I said it was juice or something like that. So I ended up getting a ticket for violating section 25662 of the B&P code. I can either pay a fine or take it to trial. I'd like to take it to trial and get the case dismissed or found not guilty, but do I have a case even though I admitted that I was drinking?

Lesson learned: Never answer a question from a police officer. I would have poured it out or spilled it accidentally on purpose (being careful to miss the cop).
