Record clearance for domestic violence cas
I was convicted of Domestic Violence charges, and I was sentenced to 3 yrs probation, 52 weeks domestic violence classes, and 40 hours community service.
I have completed all of them, except my probation which ends in August 2005. I don't have any pending court dates or meetings with probation officer.
I want to get my record cleared at the end of probation. The problem is that by that time, I will be back in my home country India. Is there some means I can apply for record clearance from overseas? Or can someone else (lawyer, etc.) apply it for me in August 2005?

Any of us would love to take your money. But seriously, go to your local courthouse and ask them if they have a form for a Penal Code Section 1203.4 expungement, and ask what the filing fee is. When your probation is up, assuming you have not gotten in any more trouble, send in the form along with a money order in US funds for whatever the filing fee is, and a pre-stamped return envelope (maybe you should buy the postage, and possibly a money order, before you leave).
Note: I don't know what, if any, impact your conviction or future Section 1203.4 expungement might or (might not) have on your visa status.

Mr Stone is correct, except, my experience is that you should contact the probation department and request the form and the processing fee. If you are crime free then the process is pretty much a clerical process. If something goes wrong you can retain an attorney to complete the process.
