Legal Question in Criminal Law in California
Recourse for defendant in dismissed case?
i was wrongfully arrested for being & driving under the influence of meth. the arrest resulted in me losing my car.
when i went to court on the day listed on the citation i was on the no complaint calander, sme thing the next time i showed up for the subsequent date they gave me, at this time i was still on the no complaint list. I called the court a couple of weeks after that and still no charges were filed.
in the mean time dmv sent me a copy of the form the DA sent them telling them no charges had been or would be filed on the dui part.
they did not contact me w/ this info personally and apparently when they sent that to dmv, they filed charges, 11550, w/ the court and set an arraignment day. I was never notified of this arraignment nor that charges were filed, i had the impression after three attempts to go to court and receiving the copy of no charges filed dmv paperwork that that was the case.
arriving in court on an unrelated matter i was remanded on a bench warrant for missing the date i knew nothing of and spent 3days in jail and $2000 getting out. I always maintained my innocence and eventually the case was dismissed. Is ther any recourse? can i apply that 3days in jail to 7days weekend work i have to do? thank you

You could ask the judge. If the judge is sympathetic you might get the credit.
