Reducing felonies in order to join the military

Is it possible, and if so whom do I contact, to reduce some felonies to misdemeanors on the basis that I wish to join the military. Other than one night of recklessness, which included an assault, resisting arrest, and an auto theft, I have an excellent record. I wish to join the military but they have a limit of two felonies. Who do I talk to about this?

Contact the probaation department for the county in which the offenses occurred and request the form for having you record cleard. Some felonies can be reduced to misdemeanors, others cannot. The probation department or a criminal attorney can advise you regarding which convictions can be reduced to misdemeanors.

Whether a felony can be reduced to a misdemeanor depends on the felony. Some felonies are known as "wobblers" because the can be charged as either a felony or a misd. Penal Code Section 17(b) allows a court to reduce a felony to a misdemeanor on motion by the accused. If you have successfully completed your probation and any other terms, you have a good probability of getting your charges reduced. Showing a good cause, such as desire to enter the military, also helps. In some cases, you can get the felony reduced to a misd., then get the misd. dismissed under Penal Code Section 1203.4. Consult with an experienced criminal defense attorney in your area.
