Release of Seized Property
My husband accepted a plea on April 4,2002 and we waited the 60 days, as instructed by our counsel, to file the stipulation for the release of property. As of today, September 17,2002 we have not had the stipulation signed off on and are begging for what belongs to us to be released. Is there a time frame of the release of property? We are going in circles because our attorney ''can do nothing'' and I fear the property will be destroyed.

Penal code section 1538.5 provides for one in your position to file a motion for a court order for the return of property.
