Legal Question in Criminal Law in California
remodify
my fiance is incarcerated at the lerdo facility in kern county. he is wondering what he needs to do to try and get the judge to remodify his drug case, prop 36. he has failed this program for never signing up for the actual program all three times he was suppose to. the news was talking about overcrowding prisons. he has been told he would get the max 3 years in prison. he is hoping the judge can see he is not violent, he has a drug proplem, more prison time will not help and possibly remodify his sentence.

Re: remodify
Well, it sounds like he is being punished for not following the judge's orders, not because he has a drug problem. He was given three chances to sign up for Prop. 36.
