Legal Question in Criminal Law in California

Remove a misdeneanor case

Dear Mr. Nelson:

I had a misdemeanor case in 2001 and has asked the court to allow me to Ibe 'expunged' by appropriate 1203.4 motion and pleadings to the court. The court has allowed me to do so in 2005. However, when i buy a background check and check the case on California Superior Court website to check, it still shows the case with short description about the case and when it was expunged' by appropriate 1203.4 motion. So, i guess my employer can see it to. Please advice me of how I can remove the case completely or the record will stay in my record forever. Thank you very much for your help.

Sincerely,

Re: Remove a misdeneanor case

I am aware of this problem with the Orange County court website and I would consider taking your case as a federal case for violation of your civil rights. That said, I would not necessarily assume that this information will come up on an employment background check. Please contact me directly about your very interesting legal problem.
