Legal Question in Criminal Law in California
Removing a No Contact Condition of Parole
I was a minor when my fiance and I had a chld. He was convicted of lewd acts with a minor. He just got out in May on parole. One of the conditions is that he have no contact with me & our daughter. I went to his motel to take him food. 3 days before I ths happened, I spoke to the parole officer and asked to have the conditions removed since that was what I was told to do by another officer in the same office, and he told me no and to stay away from my fiance. He arrested my fiance for violating the no contact order, but I was the one who went there. He didnt even know I was going to show up, and he asked me to leave once he answered the door.I said ok and as I started handing him the bags, still standing in the doorway and not in the room, his parole officer pulled up. How can we get the no contact order removed so that he and I can finally get married and raise our child together without violating his parole again? He is curently waiting for a parole hearing in DVI in Tracy, California. Is this something I need to go to so that I can ask the parole baord to change the no contact conditions?
