Legal Question in Criminal Law in California
Removing a misdemeanor from your record
Five years ago, I was convicted of misdemeanor grand theft and I served 3 years probation for the crime. I had never been in trouble with the law before, it was an ignorant mistake on my part. Anyway, I would like to know if I can get it removed from my record for purposes of getting a job. I have been an upstanding citizen as of that date. If this is possible, can you please tell me how to go about it and who well still be able to see the information besides law enforcement. Thank you

Re: Removing a misdemeanor from your record
Contact the probation department. It should have a form that you fill out and submit along with the required fee. A probation officer will check you record to determine if you qualify. If you qualify for removal of the conviction a petition will be submitted to the court for a judge to sign.
The judge then withdraws your guilty plea, sets it aside, and then dismisses the case. Your personal history will show a conviction with the guilty plea being set aside and the case being dismissed. Government agencies will still be able to see this case on your record. However, the fact that you had the guilty plea withdrawn and the case being setaside.
