Legal Question in Criminal Law in California
resisting arrest/ officer injured
My boyfriend was arrested for being drunk in public and resisting arrest and an officer broke his ankle by his own clumbsiness. My boyfriend was never given a breath alyzer or a blood test to prove that he was drunk. He's being charged with a felony and I was wondering how much time do you think he will serve.

Re: resisting arrest/ officer injured
Resisting arrest is a felony. That is the biggest issue here. Was your boyfriend causing a raucus? What was the probable cause for the officer thinking that he was drunk? Please contact my office at 310/277-1707 to further discuss your legal options?
Sincerely,
