Legal Question in Criminal Law in California

restitution

Hi,

I have a restitution amount of 30,000 dollars which i was paying on time for 5-6 months. I decided to file bankrupcy on my other financial obligations due to financial hardship and the department of revenue recovery stopped sending me a bill till the bankrupcy was finalized. After my bk was discharged i started to recieve my bills again from drr but this time they started to add interest. i didnt know that bk would make my restitution payments delinquent. Even my bk lawyer told me not to pay ANY bills till my bk was finalized. Is there any way to get the interest removed for this reason? i am only paying 150 a month and interest is 10% of 30,000 annually whichs equals more then what im paying.

Please help me. any advice would be useful.

Re: restitution

You should have your lawyer involved in this obviously.

Very often a deal can be struck with a judge. If you perform well certain things, fees or interest, could be forgiven. Your lawyer should bring these issues up to the judge, either in a motion or orally.

Alternatively, you could try to work things out with the probation department, or the court, yourself.
