Legal Question in Criminal Law in California

restitution?

what is restitution in a criminal law case?

also, can a judgment be placed against someone in a criminal case like it can in a civil case?

further, if a person has personal assests in a criminal case and if found guilty, can the personal assest be taking away to pay restitution like a judgment in a civil case can take assest to pay the judgement?

thanks

Re: restitution?

Restitution is an order issued by a criminal court for the defendant to pay money back to victim of a crime. It is issued when the defendant is convicted either by a jury following trial or guilty plea. The court has the authority to enforce the order in variety of ways, including the power to order sale of defendant's assets.

Also, restitution order automatically becomes enforceable as a civil judgment meaning the victim can seek to collect and seize defendant's assets with or without the court's help.
