Legal Question in Criminal Law in California
Restraining Order
I would like a restraining order against someone that I feel is a threat to me. He is not a US citizen. If I am granted a restraining order will the reprecussions be the same as if her were a citizen, ie has to stay 300 feet away, or will there be more reprecussions? I believe he also has a non felony criminal record in the United States.

Re: Restraining Order
Restraining orders apply equally to citizens and non-citizens. If he is in the U.S. illegally, it is possible (though perhaps not likely) that the restraining order will come to the attention of the ICE and cause them to commence deportation proceedings.
