Legal Question in Criminal Law in California
restraining order- gag order
my boyfriend lies to his xwife and his friends about me. he lied to me regarding a '' girl friend'' i found out and while he sat talking to her in his car, mocking me i went crazy and kicked his car causing 600 damage. He reported it to the police and they came to arrest me but let me go there a report. He told them he didnt want to press charges after i told his x wife and he denied it she said my calls, the ones she returned, were harrassment. He placed a restraining order on me, and then took me away for the weekend. It was made perminant this week and that next day he was saying he was so sorry and that he would do all he could to remove it. Can he remove it? his x wife and girlfriend are listed in the order and this is a gag order as hes still seeing me on a regular basis. I had a lawyer write a letter for me stating all the interactions we have daily at his request and the judge wouldnt even take it without the lawyer present. boyfriend doesnt think its a big deal, just a way to keep me behaving. What do i face if i continue to see him?

Re: restraining order- gag order
A restraining order is a court order and you would be wise to obey it. You could wind up in jail if you are caught, or tricked into, violating it. If your relationship has gotten to the point where you find youself needing to trash his car, maybe you are better off without him. Otherwise the violence will only get worse, and somebody could get hurt or killed.
