Legal Question in Criminal Law in California

restraining orders

what are the requirments needed to obtain a restraining order against an ex-boyfriend who is calling constantly and who comes by my home, pounds on the windows and doors to talk to me. He is frightening me and my children. He has also made general threats that if I dont talk to him I will be sorry and that he will physically harm anyone who tries to help me against him. He said that if I dont 'want s... to go down I better talk to him.' I haven't spoken with him for two weeks.

thank you

Re: restraining orders

The facts that you recited would support the court issuing a restraining order. You should contact an attorney or the self help program in the local court house. The next time he comes to you home call the police and report the incident. Stress that he has previously done this. Request that the police arrest him and issue a temporary restraininng order. You should take this seriously and do every thing that you can protect yourself and your family.
