Legal Question in Criminal Law in California

return of personal property

A home invasion occured at my residence were myself and one other person were shot. The police returned with a search warrant because of drug paraphenalia that was scene during the original search from the home invasion. At that time they seized my personal computer stating that they believed it to contain video survelliance from my camera system. I informed them that it did not contain any video and told them I would be glad to show them. So I then asked them to please return it to me as soon as possible. Upon my last request(40 days since taken) for its return they informed me that they were attempting to get a search warrant to make a copy of my hard drive because they believe it may contain information. What I would like to know, is if there is any way I can get my computer back? As they do not seem to be focusing on the crime that I was the victim of(home invasion,shot)but more so on what was scene and found in my home. Is there a timeline that they ahve to do this or can they just keep dragging there feet? I use this computer daily for business, personal and home survelliance and it has many years of valuable programs and information that are irreplaceable to me.

Retain an attorney to represent you and prepare the necessary motion for the return of the computer.
