my cousin just got arested for robbery and im wondering how much is the min and max time she can get thanks

It really depends on a lot of factors. Also Robbery and theft are different and a lot of people mix them up. robbery is the "felonious taking of personal property in the possession of another, from his or her person or immediate presence and against their will, accomplished by means of force or fear." Now if that is what your cousin is accused of then it is Robbery. It is also known as CPC 211. There are also different degrees of Robbery and that will also effect the sentence imposed. Generally Robbery alone in the 1st degree is punishable by three, six or nine years in State Prison. However, that can change depending on the circumstances and if there are aggravating or mitigating (facts to reduce sentence) facts regarding the actions of the defendant. Second degree Robbery carries basic sentences of: three, four or five years. Again, there will be things that can increase or reduce the sentence. The times mentioned are only a starting point. It depends on the facts of the case, her record, whether or not there were weapons and if the vixtim was injured.
Robbery carries 2, 3, or 5 years in prison - then add od for the things I mentioned above.
Robbery is a strike under California's three strikes laws, so she needs good representation to have a chance at fighting and avoiding prison and a record.

In California, there is no minimum time, and, since I don't have a penal code handy, suffice to say that, without knowing more, he's looking at possible years in prison, if convicted. There are various variables like...prior record...any weapon used..(personal use of a firearm adds a possible 10 years). Just did some research regarding possible max exposure...depending on the specific type of robbery alleged, yout cousin is looking at max exposure anywhere from 5 years to 9 years....and remember that is not including any of the variables I mentioned in my prior response. Dave Wallin
