Legal Question in Criminal Law in California
My roomate stole money from me (forged a check) and bought his girlfriend a phone with it. He has no money do I have any way to take and sell the phone?

I'm afraid not. If what you say is true, your roommate has committed a serious crime. He also owes you money. But that would not entitle you to take the phone even if he still had it, let alone after he gave it to his girlfriend. The law frowns on victims who resort to self-help in situations like this. The phone was never your property to begin with and isn't your roommate's property anymore, so even if you sued him and won the court could only award you money. Besides, it sounds like the girlfriend has done nothing wrong. Her boyfriend's misdeeds are not a good reason to take her phone away.
