Legal Question in Criminal Law in California

Scared in Vegas

My parents received in the mail a letter stating there is a warrant out for my arrest. It is for a MIS-Burglary 2nd degree(460.(b)). The incident took place back in 8/96. In the meantime I passed a background check to get the job I have right now. I'm planning on being a Juvenile probation officer. Back in 96' I bailed out and never came back to address the charges. It happened in San Mateo County, CA. Since 8/96 I have had no police contact, and have received a degree in Criminal Justice. Is this a last chance effort to clean their caseloads. Does the statute of limitations apply here? I don't want to skirt out of my responsibilities, but I also don't to have a MIS-Burglary charge on my record either if it can be avoided. What would you suggest I do.

Re: Scared in Vegas

Statutory limitation periods only limit the time in which the prosecutor can file charges. Presumably the charges against you were filed before the deadline. Arrest warrants last forever, so this matter will hang over your head until you (a) approach the court and resolve it one way or another; (b) are arrested; or (c) die. The best approach is probably (a).

You should hire a lawyer in the San Mateo area to represent you and help you get the most favorable resolution you can -- hopefully one which will not derail your career plans.

Good luck.
