Legal Question in Criminal Law in California

Screwed by a public defender

A woman my son knows implicated him in a mugging that she did. My son explained to his court appointed public defender that he was not involved in the mugging nor did he have any prior knowledge of it, and that he was not aware of the mugging prior to being arrested. The PD assigned to my son told him if the went to trial there wasn�t much he could do for him because the police had too much evidence proving his involvement and he would end up doing 3-5 years in a state prison. He advised him that it was in his best interest to plead guilty and he�d only do 10 months in county jail. The PD refused to show us the police report, stating it was against the law for him to show us the report prior to my son making his plea. Afraid of state prison my son pled guilty, even though he was innocent. When we finally did get a copy of the 98 pg. police report, the only evidence in it was store video taken many hours after the mugging of my son accompanying this woman while she shopped using the stolen credit cards and her statement claiming he forced her to mug the woman, which she later recanted. Did we have a right to see that police report prior to my son making his plea? And is there anything we can do to right this injustice?

YOu should take the police report to an attorney for a review. The attorney is in a better position to evaluate the evidence against your son. Then the options available can be discussed.
