Legal Question in Criminal Law in California

Sealing a misdemeanor

I was arrested based on an invalid traffic warrant approx. 5 years ago that ended in a misdemeanor arrest. It resulted in a non-conviction but is ruining my chances of getting a security clearance and getting back into aerospace. Please help. What are the form numbers and names that I need to do this myself? What would an attorney charge?

Thank You,--name removed--Kubik

Re: Sealing a misdemeanor

Thank you for your posting.

I am not sure you need to seal a conviction that never happened. If, as you've stated, the case ended up in a "non-conviction", there is nothing to seal, as the case was either dismissed, reduced, or you were acquitted at trial.

If you had a misdemeanor conviction, you may be eligible to have it expunged if you meet certain requirements. However, you would have to be more specific regarding a county for form numbers, and to quote a fee, almost any attorney will need more information about the "conviction", if there is one.

I hope that this information helps, but if you want more information, have further questions, or feel that you need legal representation, please feel free to email me directly at [email protected]. It's my pleasure to assist you in any way that I can.
