Legal Question in Criminal Law in California

search, seizure & vandalize warrant for doing no wrong?

My place was recently raided by the SF police.

There was nothing illegal on premise.

Posessions were taken and things broken after

never being arrested. Then or now. They took

$3500 in US postal money orders, and I want to

know how to get that $ back and what grounds

might I have to sue. They really f**ked up their

search I think and I want to know for sure. Thank

you.

File a complaint with the SF city clerk regarding the damages resulting from the police executing the search warrant.

California Penal Code section 1538.5 provides for the return of property taken by the police.

Write the police, complain, and ask for the return of your property. Did you get a receipt from the police? Was the money orders filled out? Did you tear off and keep the little tags at the top? Depending on your answers to these questions. You might report the loss of the M/Os to the Postal Service, and have your M/Os replaced. This is to suppliment the previous answer. If there was no receipt from the S. F. Police, and the M/Os were not filled out lots of luck.

You can write a complaint to the corresponding agency. Were the money orders filled out? Do you have the receipts? You can take those stubs back and have them voided and get new ones. If you do not have any receipt, I am afraid you are out of luck.
