Legal Question in Criminal Law in California

sentence served and still not released from jail

My friend served her 60 day sentence. 3 days after she turned herself in, she was booked again on a probation violation. She was never released after the 60 days was up and has been in custody for over 100 days now. She keeps going to court just to reschedule another court date, 4 times. They wont tell her why or what for just that they are still investigating. Is this legal? And what can be done to get her released? Does this make any sense? Please help.

Thank you for your posting and your inquiry.

It sounds as though your friend has a public defender, and that your friend has been waiving time to negotiate the resolution of the probation violation. She will get credit for any time served, but if she's been in custody 100 days on top of the 60 day sentence, the offer as to her probation violation, or the basis for the violation, must have been serious indeed.

I hope that this information helps you, but if you have further questions, want more information, or feel that you need legal representation, please feel free to email me directly at [email protected]. It's my pleasure to assist in any way that I can.
