Legal Question in Criminal Law in California

Sentencing a minor for drug-dealing in California

If a 17 yr. old with no previous arrests for drug offenses but with a history of other non-violent offences (mainly confidence game scams) were convicted of dealing drugs to a 10 yr. old in California, would he likely serve the first part of his sentence in a Youth Offenders Home and the remainder in prison or would he likely be sent directly to prison?

I believe that is one possible scenario for a sentence.

The law turns on the facts, and you've not provided me with sufficient facts to offer a definitive opinion as to the possible sentences. And the sentencing guidelines are different for State and Federal violations for the same crime.

But this kid needs some psychological counseling, and his anti-social behavior needs to be appropriately treated.

If that doesn't work he can be warehoused for a considerable number of years. Twenty to life comes to mind. However at this juncture in his life that seems to be an overkill.

Lots of luck
