Legal Question in Criminal Law in California
Sentencing-how much time will he actually do?
Hi,
My fiance' was oferred a deal of 16 months in the state prison. He has already done 3 months in county jail. He has no priors and this wasn't a violent crime. I've heard he won't have to do the full 16 months, only 10 months or so. Is this true?

A prisoner who receives good time and work time credit will receive 2 days credit for each day in custody. Thus in theory a prisoner would serve 1/2 of the actual sentence. However in reality the prisoner does not receive the work credit until he have been placed at a facility and has been cleared for a job. The estimate appears to be in the ball park if everything goes well and he receives the maximum credit.
