Service of Documents

How do you personally serve documents for a temporary restraining order to stop harassment in CA if the person to be served is in jail/correctional facility?

Re: Service of Documents

1. You use a professional process server (not the sheriff). Be sure to provide the inmate's full name, date of birth, and booking number (often available from the jail or sheriff website).

2. Service is affected by "sub service" by delivering a copy of process to the warden's designated agent and by mailing a second copy to the defendant.

The process server you hire will be familiar with the legal requirements for serving the inmate.

Re: Service of Documents

P.S. Remember sub service takes 10 extra days, so set your hearing date far enough out for sub service to be completed. Maybe you should contact the process server before you apply for the TRO.
