Legal Question in Criminal Law in California

Sexual Offense commited 24 years ago

My husband has been arrested and arraigned for a sexual offense in December of this year. He was investigated for a similar offense 24years ago. The victim of that offense was contatcted and gave evidence concerning the offense. I belived he is only being prosecuted for the current offense and not the past. Am I correct in this?

Re: Sexual Offense commited 24 years ago

That is a very difficulkt question to answer without knowing exactly what happened 24 years ago. It is possible that charges could be brought from what happened 24 years ago. It is also equally possible that 24 years ago is gone because of conviction, dismissal, acquital or statute of limitations. At a minimum, the prosecution may be allowed to introduce evidence of the event 24 years ago in the present case. Thus, they contacted the victim from 24 years ago. You should hire an attorney to find out exactly what your husband is facing and why.
