Legal Question in Criminal Law in California

i got shoplifted from macy's. The civil demand is for $601.00. i have paid $395.00. I received a ticket but did not get arrested. My court date is on 10/21/2011. what is going to happen?

It sounds like you got caught shoplifting and an officer was called and gave you a citation. If that's correct, you actually DID get arrested, but "cite released". The civil demand is separate from any criminal case that may be filed - paying it won't change the outcome and ignoring it won't make it worse. Now that you've paid a portion, that's between you and the law firm that's collecting on behalf of the store.

As far as your criminal case - either you or an attorney on your behalf must appear in court on that date. If you are able to afford an attorney, I'd suggest hiring one ASAP and discussing the situation with them. Look for an attorney that focuses on criminal law and who routinely practices in the court where your case will be heard. They'll know what the likely outcomes are and what can be worked out on your behalf.

If you cannot afford an attorney (and you'll never know until you meet and discuss the case and fees), then you'll have to show up on 10/21 and request a public defender.
