Shoplifting

I was caught shoplifting, and I would like to know if I will have to do time or if there's a way I can avoid jail alltogether. I have a prior conviction of felony grand theft from 4 years ago, served 90days on that. Also a possion of methamphetimine (.8 grams) served 90 days for that 6 months ago. On both charges I had a public defender and just took what they said was the best deal I could get. Could of a hired attorney got me a better deal and can I keep from going to jail this time. Its very important I don't go to jail and will pay a fine or alternitive sentance. Jail would have a devistating impact on my life and my family. I go to court on Nov.2nd. Thank You. Sincerly

Thanks for your posting, and apologies for the length of time it took for you to get a response.

You mentioned that your court date was 11/2, so this may be moot, but yes, there are ways of avoiding jail time for small sentences, by giving a good presentation to the court as to why your sentence should be converted to something else.

A good attorney does this all the time and should be able to help you.

Shoplifting should not get you jail time. However, if they violate your probation you could be facing some prison time on the 1st offense, and on the 2nd offense possibly some more county time (local lid). This assumes you have not completed your probation time on one or both offenses. You'll also be getting a bill from the store to assess you some cost for their security program.
