Legal Question in Criminal Law in California
shoplifting
Last October my sixteen year old daughter and her friend were caught shoplifting in a department store. I was called and asked to come pick her up and no police were called. Today I recieved a letter from a law firm saying that the store had filed a claim against us pursant to Calif. penal code section 490.5 (b)(c). They are asking for $295.00, which we are asked to pay by check or credit card or they will seek further legal action. Is this a scam or are we legally obligated to pay this?

Re: shoplifting
A merchant can demand reimbursement for costs incurred in apprehending a shop lifter etc. You may want to contact the store and discuss a settltment at a reduced price.
