Legal Question in Criminal Law in California

My sister was arrested for a petty theft charge she did not commit she put some batteries in her cart and her friend took them out of cart with out my sisters knowledge and pocketed them. My sister only corrected the store clerks lie (He stated he saw her friend take batteries off shelf and put in her purse) well my sister be the honst person said no that not true and that she placed them in her cart and was intending to buy them and did not know her friend even took them out and even offered to still pay for the item they refused is there anything we can do

With regards to petty theft, your sister has two options at this point; a) to negotiate with the DA and if the case is week that could result in an infraction type if she does not want to proceed further and b) she can fight the charges.

I order to assess this case better, it is important to see what is written in the police report and what other evidences DA holds such as if there was any video tape. Usually on arraignment day, DA will provide these information to the defense and based on that, we can see what would be the better option for your sister.
