My son was arrested and the didnt find a gun can he still be charged.

Charged with what? Possession of a gun? Use of a gun during another crime?

The short answer is yes, he can be charged. Whether or not the DA will be able to prove that it was a real gun or the other elements of whatever offense he's facing is another story.
