Son on Diversion Program

Son plead guilty to a felony cultivation charge and was given a diversion program for 16 mos. He has done the required service, is now just waiting out the time to get the felony exsponged, and has a opportunity for an education requiring a background check. His brother is a volunteer for the Sheriffs and reports the felony is not listed on the computer. When stopped for a broken light,however, the officer knew he was on a diversion program. The question is, will this felony show up on a background check even though it is not part of a perminant record at this time?

You need to discuss this with an attorney. Generally when the diversion program is satisfied the court will with the guilty plea and dismiss the charges. Thus resulting in no cinviction. The matter is therefore not a conviction. There would be no reason for an action to expunge a conviction.
