Legal Question in Criminal Law in California

My son was at a party with gang members, a fight broke out and one of the men he was with shot and killed someone. they left in my son's car. I was told he will be tried for murder even though he did not kill anyone. As a matter of fact they will try all six men who were there together.

It's very possible that he will be charged as an accomplice or at a minimum, an accessory to murder. My suggestion would be to contact a good defense attorney in your area. As a former DA in Solano County and private defense attorney there as well, I am intimately familiar with the defense bar there. I'd suggest you call Daniel Russo for advice and possible representation. You don't want your son convicted of murder if he wasn't responsible.

The prosecution will assert that all of the defendants were acting in concert. Assuming you can afford a good attorney, hopefully the attorney can distance your son from the main culprits in this murder. The more he can be distanced, the better chance of a better disposition. Also, if the prosecutor doesn't have the strongest case, they may be looking to use one of the least culpible as a witness, so the more your son's participation can be minimized, the more likely he can be one of the defendants the prosecution will reach out to, to make that kind of a deal.
