Legal Question in Criminal Law in California
My son has been sentenced to 20 years in prison..he has been in the county jail for 2 yrs 9 months,my question is how much time will he serve?? how much credit will he get for being in the county jail?? will he receive 85% of his actual sentence?? he is in Robert Presley Detention Center in Riverside ,CA
1 Answer from Attorneys
It depends on his current charges. If he was convicted of a violent felony listed in Penal Code 667.5(c), he would serve 85%, minus the time he has served in jail and about five months of good time credit.
If he had a prior strike conviction under the Three Strikes law, he would get about 16 months of additional credit for his jail time and serve 80% of the balance.
If neither of the above applies, he would get the 16 months of good time added to his jail time, then serve half of what's left.
