Legal Question in Criminal Law in California

Speeding Without A Limit

beverly hills,CA motorcycle cop with radar says he clocked me at 48 in a 25mph "school and church zone". His direct line of sight was no more than 120 yards. i never saw him point the radar at me, he was just standing there waiving me over.

I went back over the route--there is only 1 speed limit sign entering the city and it says 35mph. there are no speed limit signs on this street. there are no school signs posted, no church signs posted, no x-walk signs or markings on the street. There is one sign that says 25mph--if you are heading north. I was heading south.

the street is a wide residential street, 3 lanes in each direction with an island,

separating north and south.

questions:

1-does he have to spot me visually? he would have about 3 seconds to spot me, get a reading on his radar unit and be there standing and waiving me over. It seems almost impossible to me.

2-the street does not fit into res/or bus definition.

3-it was in the middle of the summer at 8:30 in the morning.

4-can i proceed as if it were a speed trap.

thanks in advance for your help!

Nolo Press has an excellent book on fighting your traffic ticket. This book should answer all your questions.

A traffic survey must be on file with the clerk of the court or the radar reading cannot be used, see the Nolo press book.
