how does the right to a speedy trial work? i was arrested over 74 days ago and still have not plead nor have i waived time isnt there a time issue here or due process. please let me know also if it only means when you are in or out of custody

If you are in custody, you have to be arraigned within 3 days. It doesn't apply if you are not in custody. Right now, you are waiting for the statute of limitations to run prior to the filing of an accusatory pleading. You don't provide much information, so I cannot tell you which statute of limitations you are waiting on.
