Legal Question in Criminal Law in California

State Prison Transfer Request

What is the procedure to follow, if any, in requesting a prison transfer of an inmate to a facility closer to his family? He is serving 25 years, but has already served 6.

Thank you in advance

Re: State Prison Transfer Request

Write the warden and request the transfer. They have procedures and should tell you what they are. There are prisoners' rights groups, and I'd search the Internet to check and see what the procedures are.

The prison system can move prisoners around for the prison's convenience. So the prisoner has no rights where he/she'll serve their time.

However, he might be subject to being moved, and they might do you a favor by moving him closer to home. It's worth the price of a letter, and some time on the internet.
