Legal Question in Criminal Law in California

Out of state warrants!

My boyfriend was arrested in Indiana for a 1996 violation of probation order from California. The original charge was for Inflicting Corporal Injury to Spouse/Cohab.

Apparently, when he moved to Indiana in 1997 the probation was transferred to Indiana. He flunked a piss test in Indiana and his paperwork was sent back to California and he never heard anything from anyone after that point.

Over the next 7 years he was arrested and put in jail on 2 other occasions here in Indiana. I think once was for battery; and the other was for driving while suspended. A warrant search was done on him during this time and nothing came up and he was released.

He was pulled over for speeding this year and the officer ask him if he knew he had a warrant in California. But they weren't interested in pursuing it or picking him up??

Why now would they show up to arrest him for this California warrant? How long can they hold him in Indiana if California never picks him up? We were told after 72 hours if they haven't picked him up he would be released, is this right??

If they do pick him up then what happens??

Need answers/No one will tell me anything????

Thank you!!!

Re: Out of state warrants!

The only way to get an answer is to retain an attorney in California where the probation violation occurred and have the attorney investigate the matter. No one can tell you what will happen in the future with the information you provided.
